T.C.A. 50-3-105(1):  The employer did not furnish employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees.
An example was the hazard of suspect accuracy of the portable
ammonia Toxi Vision monitor used by Maintenance Technicians and
Hazardous Materials Technicians (as defined in 29 CFR 1910.120(q)).
The instrument was used to define what level of respirator
protection (full face piece cartridge respirator or self-contained
breathing apparatus - SCBA) was necessary for adequate health
protection during an ammonia release incident.  The Toxi Vision
portable ammonia monitor was reportedly calibrated each 6 months,
and no span ammonia gas was available for "bump"
testing/calibrating the portable monitor at the plant.  In the
"Reference Manual" for the equipment, on p. 24, the manufacturer
recommends that a "bump" test calibration be conducted daily, and
that "the interval between calibrations should not exceed 30 days."
The employer recognized the serious toxicity of ammonia, as
evidenced by its material safety data sheet (MSDS) on that
chemical.  He also recognized the need for protection against
exposures to the gas, as evidenced by his provision of the
emergency respirators mentioned above.  Also, recognizing the
ammonia hazard, the employer had operating procedures and
mechanical integrity programs in an attempt to prevent releases of,
and exposures to, ammonia.
The above-listed employees were potentially exposed to ammonia,
which could be released if equipment leaked.  Such a leak occurred
in the engine room of the milk plant on 11/28/05.  The hazard of an
inaccurate portable ammonia monitor was reasonably foreseeable.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to follow the portable monitor
manufacturer's bump test/calibration recommendations, as delineated
above.
