Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)In the foundry area, the employer did not enforce a procedure prohibiting employees from boarding cranes while in motion. Such a procedure would allow for the safe boarding of cranes when in operation such as, but not limited to, when maintenance electricians board the cranes from the crane walkway onto the crane for adjustments and repairs, which exposed employees to crush and fall hazards. Among other methods, a feasible and acceptable method to correct this hazard is for the company to put into writing, conduct training on and enforce a program which includes the following procedures: - A method of notifying the crane operator which includes, but is not necessarily limited to, shining a flashlight into the crane cab, to get the operators attention. - A signal from the crane operator that the signal has been received. - The crane is to be taken to a boarding station and is to be boarded only at those stations. - Before boarding can begin, the crane operator must have stopped the crane, locked it down and have gotten out of the crane cab to signal that boarding could safely be conducted.
