Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of being struck by forklifts and other vehicular traffic while waiting to catch or walking to transport buses at: a)At the temporary bus stop established on or about October 31, 1997 and used through January 8, 1998, at the west side of the Vandalia Hub building adjacent to the north side of the Minimod building, employees would stand and wait to catch crew vans and buses and were exposed to the potential of being struck by vehicular traffic; One feasible method of abatement among others, is to provide barriers or shields to protect employees as they waited for or walked to the transport buses.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of being struck by forklifts and other vehicular traffic while waiting to catch or walking to transport buses at: a)The Tower bus stop on the north side of the Hub Building prior to January 8, 1998, where employees walked up to 200ft. north toward the wingtip line as they attempted to access the transport buses to other parts of the Hub and, after January 8, 1998, employees continued to be required to walk up to 90 ft. north beyond established barriers to access transport buses and in both cases were exposed to being struck by forklifts and other vehicular traffic. One feasible method of abatement among others, is to provide sufficient barriers or shields to protect employees as they awaited or walked to transport buses.
