Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards created by failure of shop-made lifting devices referenced from American National Standard ANSI B-30.20, Below-the-Hook Lifting Devices, Section 201.2.1 - MARKINGS. (a)RATED LOAD MARKINGS - The rated load of below the hook lifting devices was not marked on the main structure where visible. IDENTIFICATIONS - Nameplates or other permanent markings were not affixed displaying the following information: 1) Manufacturer's name 2) Serial number 3) Lifter weight, if over 100 pounds 4) Rated load FORGE DEPARTMENT: Lifting Devices at forging machines series (1) 12000 pounds, (6) 8000 pounds, (1) 6000 pounds, (1) 5000 pounds, and (2) 4000 pounds! RAILROAD PRODUCTION AREA: Two (2) Below the hook lifting attachments used for lifting suspension/center plates weighing between 110 pounds to 200 pounds Among other methods, acceptable means of abatement would be provision of either permanently affixed tags, or actual marking of the device with the data required above.
