Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck and/or crushed by a moving material incline lift: (a) Location - At The Establishment, 30 Factory Street, Everett, MA: On or about 2/5/97, the employer allowed employees to operate an incline lift (no identification number) with the interlock switch by-passed with fabric lace and with the sliding bolt missing on the incline lift entrance door, door knob. Assembly causing the lift to continue its downward motion with the door open. One feasible and acceptable abatement method, among others, to correct this hazard is to make sure the interlock switch is never bypassed and make sure the sliding bolt is complete and working on the incline lift entrance door knob assembly.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling when an incline lift dropped from a higher to a lower floor while they were riding it: (a) Location - At The Establishment, 30 Factory Street, Everett, MA: On or about 2/5/97, the employer allowed employees to ride an incline lift that was not designed for personnel riding. One feasible and acceptable abatement method, among others, to correct this hazard is to make sure that employees are trained to operate a material incline lift and do not allow anyone to ride a material incline lift. Prominently, post warning signs at each point of access and each point of operation.
