Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
walking and working throughout the yard were exposed to being struck by
self-propelled heavy
equipment:
(a) Location: Yard Area;
Self-propelled heavy equipment operating throughout the yard was not
properly
maintained to ensure reliable operation.  One feasible and acceptable
method to correct
this hazard is to perform scheduled preventative maintenance at least as
frequently as
listed in the manufacturers' maintenance manuals.

Self-propelled heavy equipment operators were not adequately trained to
safely operate
such equipment.  One feasible and acceptable means to correct this hazard
is to develop
and implement a comprehensive training program to be successfully
completed prior to
employees operating heavy equipment.
