Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)Employees in the knockout/shakeout area of hard iron are being exposed to respirable dust containing silica in excess of the calculated PEL. The employer has not performed testing and maintenance on the ventilation exhaust system in the knockout/shakeout area of hard iron to ensure continued optimum performance to remove respirable dust containing silica as originally designed. Feasible and acceptable means of abatement would include implementation of the requirements outlined in (NFPA) National Fire Protection Association standard 91 Chapter 7 for testing and maintenance of ventilation systems. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
