Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) Prior to the incident which occurred on September 25, 1995, the
employer failed to institute
an adequate program to ensure that hydraulic mechanics were completing
re-torque inspections
at the elbow bearing according to the manufacturers specification and/or
recommendation for the
Altec AM series style boom.
A feasible and useful means of abatement includes, but is not limited to
the following actions:
1. Ensure that all hydraulic mechanics are properly trained in accordance
with existing
procedures emphasized in the Altec, "Instructions For AM Elbow bearing
Replacement Kit P/N
750-40058".
2. Devise a program to ensure that all bolts in the elbow bering are
re-torqued according to the
time intervals specified and/or recommended by the manufacturer.
3. Devise a means of communication between the various transportation
garage to ensure that
hydraulic mechanics are aware of when a re-torqued is required for trucks
which are serviced
on multiple sites.
