Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Employees in the laboratory and environmental service departments were
exposed to the hazard
of being infected with tuberculosis through contact with an infectious
tuberculosis patient in that:
They were not provided with training and information to ensure their
knowledge of issues such
as: the hazard of TB transmission, its signs and symptoms, medical
surveillance and therapy,
and site specific protocols including the purpose and proper use of
enginneering  controls.
Feasible and useful abatement would be to provide training on the above
items to all employees
who may come in contact with suspect or confirmed cases of tuberculosis
while carrying out
their job duties.g
