Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On August 14, 2002, at Superior Industrial Coating, the employer did not enforce the use of the operator restraint device on the G- 25S Daewoo powered industrial truck which exposed employees to the hazard of being crushed by the forklift should it overturn. The hazard of entrapment of the operator and being thrown to the ground are recognized by the current consensus standard, ASME/ANSI B56.1a-1989 Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks. One feasible and useful method of abatement to correct this hazard is to enforce the use of the operator restraint/seat belt with which the forklift is equipped. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
