Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)At the worksite at 7th Ave. and West Paradise Dr., West Bend, WI 53095
the
two laborers applying stucco to the south side of the Home Depot under
construction were working from the basket of the Genie extending boom
platform
(self-propelled) and had no personal fall arrest system.  The laborers had
full
body harnesses and lanyards in the basket with them but were not wearing
them.
Among feasible abatement would be to comply with the American National
Standards Institute (ANSI) A92.5 - 1992 Standard for Boom-Supported
Elevating
Platforms and have employees wear fall arrest equipment whenever they are
in
an aerial lift.  Without such protective equipment the laborers were
exposed to
the hazard of falling to the gravel about 30 feet below.
No certification required.  Violation Abated.on
