Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The

employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees
working on the top of railroad tank cars were exposed to fall hazards that
could lead to death
or permanent disability:
a)On and before July 1st, 2003 employees were exposed to fall hazards of
more than 12 feet from the top of railroad tank cars.  Employees would
work on the top of the rail car daily without protection from falls.  One
feasible and acceptable means of abatement would be to install and require
the use of a personal fall arrest system while employees are on top of the
rail car.
IN THE ALTERNATIVE
29 CFR 1910.132(a):  Personal protective equipment was not provided when
necessary by
reason of hazards of processes or environment capable of causing injury or
impairment:
a)On and before July 1st, 2003 employees were exposed to fall
hazards of more than 12 feet from the top of railroad tank cars.
Employees would work on the top of the rail car daily without
protection from falls.
No certification required.  Violation Abated.on
