Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury from the accessible portion of the swing radius of the Caterpillar power shovel. 185 EAST MAIN STREET: On or about 6/24/97, the company superintendent was struck by the counterweight of a Caterpillar power shovel, when the machine was turning to dump a load of dirt. Among others, one feasible means of abatement would be to provide a swing radius barrier on the accessible portion of the machine. "ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM"
