Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: falling off the loader and being run over by the rear tires. a) Construction Site - Employee was observed riding on the out side of the rubber tire load for a distance of 1/2 mile up a dirt road. Employee was exposed to falling off and being run over by the rear wheel. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the employee to walk behind the equipment or have the equipment operator connect the lifting device to the sewer manhole sections.
