Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury from a falling counterweight: (a) Phase II Plant; C-5 Conveyor - Where the counterweight for the conveyor was supported by a 3/4" wire rope it was not confined in an enclosure designed to prevent the presence of personnel beneath the counterweight, on or about 11/15/93. ABATEMENT NOTE: Among others one feasible and acceptable method to abate this hazard is to confine the weight inside an enclosure or provide a means to support the weight in the event of failure of the normal support.
