General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from platform of scissors lift used above the 12-foot eave height with damaged and missing guardrails. A feasible method of abatement is described in American National Standards Institute A92.6-1990, "Self-Propelled Elevating Work Platforms" which requires a guard rail system that includes a top rail 42 inches above the platform; a mid-rail approximately midway between the platform and the top rail on all sides; and a toe board, four inches high on all sides except at access opening. and/or in the alternative 29 CFR 1926.451(a)(5): Guardrails were not approximately 42 inches (106.68 cm) high, with a midrail, when required: (a) Building "N", guardrails on scissors lift used above 12-foot (3.6576 m) eave height were damaged, reducing the height and strength of the guardrail. (b) Building "N", access opening midrail missing on scissors lift used above 12-foot (3.6576) eave height.
