Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)The hazard of being crushed by a non-operative coupler on an American Locomotive crane, model no. 840E, serial no. J4263, #133 when switching cars. One feasible and acceptable abatement method, among others, to correct this hazard is to replace or repair the defective coupler as specified by paragraph (f) in Section 231.30 Locomotives Used in Switching Service of 49 CFR 231.
