Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to increased risk of contracting Hepatitis B (HBV) or Human Immuno deficiency virus: a) THE TRAINING PROGRAM THAT WAS ESTABLISHED FOR UNIVERSAL PRECAUTIONS FOR PREVENTION OF TRANSMISSION OF HUMAN IMMUNODEFICIENCY VIRUS (HIV), HEPATITIS B (HBV), AND OTHER BLOODBORNE PATHOGENS IN HEALTH CARE SETTINGS DID NOT ENSURE THAT ALL PERSONNEL SUBJECT TO ITS PROVISIONS ATTEND MANDATORY TRAINING SESSIONS ON AT LEAST AN ANNUAL BASIS: ALL PERSONNEL FROM CENTRAL SERVICES INCLUDING HOUSEKEEPING AND LAUNDRY WERE NOT REQUIRED TO ATTEND IN-SERVICE TRAINING ON UNIVERSAL PRECAUTIONS. A FEASIBLE MEANS OF ABATEMENT AMONG OTHERS WOULD BE TO PROVIDE AN ANNUAL TRAINING PROGRAM FROM ALL HEALTH CARE WORKERS IN THE FACILITY AND TO ESTABLISH A MEANS OF ACCOUNTABILITY THAT ALL AFFECTED PERSONNEL ATTEND.
