Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were permitted
to work on roof 12 feet above ground level without adequate type of fall
protection:
a)  Route 113, 32 North Dupont Highway, Selbyville, DE 19975,
Mason Dixon Shopping Center:  During the nailing down of
plywood; in that; employees working on roof 12 feet above
ground level were not provided adequate type of fall
protection; 2-27-92
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to provide employees with personal protective
equipment in accordance with 29 CFR 1926.28(a), such as safety belts/
harnesses and lanyards.
OR IN THE ALTERNATIVE
1926.28(a):  Appropriate personal protective equipment was not worn by
employees in all operations where there was exposure to dangerous
conditions:
a)  Route 113, 32 North Dupont Highway, Selbyville, DE 19975,
Mason Dixon Shopping Center:  During the nailing down of
plywood, employees working on roof 12 feet above ground level
were not provided with safety belts/harness and lanyards; 2-27-92
The alleged violations above have been grouped because they involve similar
or related hazards that may increase the potential for injury resulting fro m
an accident.
