Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about 8/12/00 employees operating and riding in the C & K Industrial
Services
vacuum truck # 264, on a private haul road, were exposed to the hazard of
being
unrestrained and or ejected from the cab of the truck in the event of a
motor vehicle
crash in that the employees were not using the occupant restraint system /
shoulder and
seat belts provided in the truck.
Among others, one feasible and acceptable method to correct this hazard
would be to
take steps to ensure that employees operating and or riding in the cab of
company motor
vehicles use the occupant restraint system / shoulder and seat belts
provided
in the cabs
of the trucks.d
