Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while operating the manually operated manlift in the seed house and the annex due to the lack of a midrail on the car. Among other methods, one feasible and acceptable method to correct this hazard would be to install a midrail. (b) Employees were exposed to a crushing hazard while working near the manually operated manlifts due to the lack of a guardrail around the base in the annex and a gate in the seed house. Among other methods, one feasible and acceptable method to correct this hazard would be to install a complete guardrail system with a swinging gate around each manlift. (c) Employees were exposed to a potential fall hazard while operating the manlifts in the seed plant and the annex due to the frayed and damaged manlift ropes. Among other methods, one feasible and acceptable method to correct this hazard would be to replace the ropes in both locations. (d) Employees were exposed to a potential fall hazard while operating the manlift in the seed plant due to the brakes not being properly adjusted. Among other methods, one feasible and acceptable method to correct this hazard would be to properly adjust the brakes.
