Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fire and explosion hazards:
(a) For employees using an Echo model PB-230LN portable, gas powered
blower for
housekeeping and creating a source of ignition to airborne concentrations
of grain dust
in the main house of Sun Prairie Grain in Bowbells, ND.
Among other methods, one feasible and acceptable means of abatement would
be for the
employer to remove the gas powered blower from the facility and prohibit
any further
use of similar equipment.
