Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by or crushed by falling objects associated with collapse or failure of storage racks: (a) Building 30, materials of unknown weights were allowed to be placed in storage racks, potentially overloading the racks. Among other methods, one feasible and acceptable means of abatement include the employer developing a method of determining the weight of materials being placed on storage racks to assure the holding capacity of the rack is not exceeded.
