Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential injuries due to not wearing the seat belt. a) Warehouse located at 1400 West 20th Street, Erie, PA - An employee operating a Hyster Industrial fork truck, Model #S30XL and Serial #B0100B2157E, was not wearing the seat belt on this fork truck at the time of the accident, causing him to be thrown from the fork truck.
