Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to head and/or torso entrapment between the ground and the truck in the event of a tipover: (a) Melt Shop and throughout the facility; employees operating powered industrial trucks were not required to use seatbelts. Among other methods, one feasible and acceptable method to correct this hazard is to incorporate into the existing "EMI Fork Truck Program" the requirement of the use of seatbelts by all operators. This is referenced in ANSI B56.1d-1992, Paragraph 7.39.
