Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to falling loads: a) Automotive Service Department - Employees used a two post, 7,000 pound capacity Rotary lift to elevate automobiles. The lift, Lift-07-A, had a broken handle for the lock release. This defect caused the lock on one side to stick, resulting in the vehicle being lowered unevenly; on or about April 16, 2002. b) Automotive Service Department - Employees used a two post, 7,000 pound Rotary lift to elevate vehicles. The lift, Lift-04-A, had a cable broken on the lock release mechanism. This defect prevented a lock on one side of the lift from functioning; on or about April 16, 2002. Among other methods, on feasible and acceptable aatement method to correct this hazard is to take the lift out of service until a repair contractor can fix the lifts.
