Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling off an excavator due to provisions to carry passengers other than the operator were not available on the backhoe: a.ROW at Christine Lake Road - A Caterpillar excavator superstructure was used to transport a passenger. ABATEMENT NOTE: To transport employees, vehicles which are equipped with a seat and seat belt for each passenger must be used. (Specific abatement documentation is required.)
