Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards where aluminum dusts were generated: THE EMPLOYER DID NOT ENSURE THAT THE FOLLOWING ALUMINUM PROCESSING AND FINISHING OPERATIONS WERE CONDUCTED IN ACCORDANCE WITH NFPA 65, STANDARD FOR THE PROCESSING AND FINISHING OF ALUMINUM. a) MACHINING AND FINISHING DEPT: THE "BCP AUTOBLAST"'S DRY TYPE DUST COLLECTOR WAS NOT LOCATED OUTSIDE THE BUILDING AS SPECIFIED BY NFPA 65, SECTION 2-1.5 OR PROVIDED WITH EQUIVALENT PROTECTION AS SPECIFIED BY NFPA 65 SECTION 1-4. b) MACHINING AND FINISHING DEPT: THE 12" TABLE MOUNTED DISK SANDER WHICH IS USED FOR FINISHING ALUMINUM PARTS WAS NOT EQUIPPED WITH A DUST COLLECTION SYSTEM AS SPECIFIED BY NFPA 65 SECTION 2-1.1. c) MACHINING AND FINISHING DEPT: THE 3" FREESTANDING BELTSANDER WHICH IS USED FOR FINISHING ALUMINUM PARTS WAS NOT EQUIPPED WITH A DUST COLLECTION SYSTEM AS SPECIFIED BY NFPA 65 SECTION 2-1.1. d) MACHINING AND FINISHING DEPT; THE (2) TWO, 2" TABLE MOUNTED BELT SANDERS IN FRONT OF THE PANGBORN ROTOBLASTER AND THE WHEELABRATOR TUMBLEBLASTER WHICH ARE USED FOR FINISHING ALUMINUM PARTS WERE NOT EQUIPPED WITH DUST COLLECTION SYSTEMS AS SPECIFIED BY NFPA 65 SECTION 2.1. e & f) MACHINING AND FINISHING DEPT: THE PANGBORN ROTOBLASTER'S AND THE WHEELABRATOR'S TUMBLEBLASTER'S DRY TYPE DUST COLLECTION SYSTEMS WERE NOT: i) LOCATED OUTSIDE THE BUILDING AS SPECIFIED BY NFPA 65, SECTION 2-1.5 OR PROVIDED WITH EQUIVALENT PROTECTION AS SPECIFIED BY NFPA65 SECTION 1-4. ii) EQUIPPED WITH EXPLOSION VENTS WHERE AN EXPLOSION HAZARD EXISTS, AS SPECIFIED BY NFPA 65 SECTION 2-4.5 iii) BONDED AND GROUNDED TO MINIMIZE ACCUMULATION OF STATIC ELECTRIC CHARGE, AS SPECIFIED IN NFPA 65 SECTION 2-2.6. g) MACHINING AND FINISHING DEPT: A PLACARD WAS NOT PROVIDED ON/NEAR THE 12" TABLE MOUNTED DISC SANDER'S DUST COLLECTOR " WARNING- ALUMINUM METAL ONLY- FIRE OR EXPLOSION CAN RESULT WITH OTHER METALS.", AS SPECIFIED BY NFPA 65 SECTION 2-1.7. h) MACHINERY AND FINISHING DEPT: DUST REMOVED FROM THE PANGBORN ROTOBLASTER AND THE WHEELABRATOR TUMBLEBLASTER WAS NOT DISCHARGED FROM THE COLLECTORS INTO METAL CONTAINERS, AS SPECIFIED IN NFPA 65 SECTION 2-4.4. FINES FROM THESE TWO AUTOBLASTERS WERE COLLECTED IN PLASTIC/FIBERGLASS TOTE BINS. i) MACHINERY AND FINISHING DEPT: DUST REMOVED FROM THE BCP AUTOBLAST'S DUST COLLECTOR WAS NOT HANDLED IN ACCORDANCE WITH NFPA 65 SECTION 2-4.4. FINES FROM THE COLLECTION DRUM WERE DUMPED TO A NON-METAL BIN, ALLOWING CREATION OF FUGITIVE DUSTS.
