Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to potential fire and explosion hazards in areas where fine metallic dusts were generated: a) Finishing Department: The AGET dust collection system used for collection of the fine aluminum containing metallic dusts produced by the Wheelabrator Tumblaster was not designed, constructed and maintained according to established safety and health standards for prevention of metal dust fires and explosions, such as but not limited to "NFPA-65 Standard for the Processing and Finishing of Aluminum" or the equipment manufacturers own recommendations for prevention of metal dust fires and/or explosions. b) Finishing Department: The Aget dust collection system used for collection of fine metallic dusts produced by the Aluminum and Bronze Grinding and Belt Sanding line was not designed constructed and maintained according to the established safety and health standards for the prevention of metal dust fires and explosions such as but not limited to "NFPA-65 Standard for the Processing and Finishing of Aluminum" or the equipment manufacturer's own recommendations for prevention of fire and explosions. Among other methods, one feasible and acceptable abatement method to correct this hazard is to upgrade the existing dust collection systems to meet specifications set forth by the equipment Manufacturer(s) and or "NFPA 65 Standard for Processing and finishing of Aluminum".
