Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to potential fire and explosion hazards posed by locating an aluminum dust collection system inside the building and failing to provide a dust collection system equipped with deflagration venting. a) FINISHING DEPARTMENT; THE AGET DUST COLLECTION SYSTEM LOCATED INSIDE THE BUILDING USED FOR THE COLLECTION OF DUSTS GENERATED DURING METAL FINISHING OPERATIONS INCLUDING BELT SANDING AND GRINDING WAS NOT DESIGNED OR CONSTRUCTED WITH THE PROPER SAFEGUARDS FOR COLLECTION OF COMBUSTIBLE METAL DUSTS. ABATEMENT NOTE; POTENTIAL HAZARDS POSED BY THE AGET DUST COLLECTION SYSTEM INCLUDE BUT ARE NOT LIMITED TO FIRE AND EXPLOSION INJURIES TO EMPLOYEES DUE TO THE INSTALLATION OF THE COLLECTOR INSIDE THE BUILDING IN AN AREA REGULARLY FREQUENTED BY EMPLOYEES, LACK OF DEFLAGRATION VENTING AND LACK OF EXPLOSION SUPPRESSION DEVICES. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS TO COMPLY WITH THE NATIONAL FIRE PROTECTION AGENCY (NFPA) 484 STANDARD FOR COMBUSTIBLE METALS SECTION 6.3.2.5 REQUIRING THAT DUST COLLECTION EQUIPMENT IS LOCATED OUTSIDE OF THE BUILDING AND SECTION 6.3.5.6 REQUIRING DRY COLLECTORS USED FOR COMBUSTIBLE ALUMINUM DUSTS BE PROVIDED WITH DEFLAGRATION VENTING. Specific abatement documentation that this violation has been corrected must be provided within 10 days after the abatement date in accordance with 29 CFR 1903.19(d)(1)
