General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of a forklift tip-over accident because of the lack of employee restraint devices. Among other methods, one feasible and acceptable means of abatement to correct this hazard would be to install seatbelts and require the use of such on all forklifts plantwide which contain an overhead guard: ESTABLISHMENT: TWO TCM CLAMP TRUCKS, MODEL FCB1542, SER 74400547 AND MODEL FCB25-2, SER 74601014 WHICH CONTAINED OVERHEAD GUARDS LACKED SEATBELTS.
