Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) Location - Warehouse/rail car parking areas:
On or about 02/26/98, employees were exposed to the hazard of being struck
or
crushed by material on the loading dock adjacent to the railcars being
moved.
Among other methods, feasible abatement methods include:
1. Instruct all employees to check the clearance on both sides of railcars
before moving
for proper clearance from stored materials.
2.  Inform all employees of 49 CFR 217.7 requirements on "Operating Rules"
and the
Bay Colony Operating Rule "Article 102", that requires a sign reading
"STOP-TANK
CAR CONNECTED" be posted for cars placed for loading and unloading..
