Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the overhead hoist or below-the- hook lifting devices fail: a)Process Waste Area, on or about 10/6/98: Three below-the-hook lifting devices had no rated load markings and no inspections performed. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Rate and mark the load capacity of the lifting device on the main structure or equivalent. 2.Conduct frequent and periodic inspections of the lifting devices in accordance with ASME B30.20-1993, Chapter 20-1. b)Process Waste Area and LRS Dept., on or about 10/6/98: A CM Lodestar and a CM Valustar overhead hoist were not inspected annually or more frequently, depending on use, for limit device operation, as required, all functional operating mechanisms, worn or damaged parts, etc. Among other methods, feasible and acceptable abatement methods to correct this hazard are to: 1. Check upper limit switches for proper functioning, without a load. 2.Conduct frequent and periodic inspections in accordance with ANSI B30.16- 1987, Chapter 16-2. Abatement certification is required for these items.
