Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown off and struck-by a forklift truck: a)Throughout the facility, on or about 05/05/99: Employees were not wearing seatbelts provided on forklift trucks as required by ASME B56.1-1993. Employees exposed a struck-by hazard. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is to require and enforce the use of seatbelts that are provided on the forklift trucks. H.P. NEUN COMPANY INC. WAS PREVIOUS CITED FOR THIS VIOLATION OF THE OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD OSHA ACT 5a1 WHICH WAS CONTAINED IN INSPECTION NUMBER 300625134, CITATION NUMBER 01, ITEM 001, ISSUED ON 03/19/97, WITH RESPECT TO A WORKPLACE LOCATED AT SENECA FALLS, NEW YORK. Abatement certification must be submitted for this item.
