P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of getting thrown from the operator's seat and getting crushed during tipover or collision: a.Sheetmetal Department 209 - The type LP counter balanced sit-down type Clark forklift truck No. LF 20901SPC (serial number 355-704-4381) was used without any seat belts, on or about 8/26/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain counter balanced sit-down type industrial trucks with seat belts and require the operator to use them.
