Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from moving construction equipment, in that: On September 9, 1997, employee(s) of Earth, Inc. engaged in sewer and water construction at the Lincoln Ridge Project in Lincolnwood, Illinois were transported around the jobsite while standing on the front end loader. Among other methods, one feasible method to correct this hazard is to enforce a work rule that prohibits riders on construction equipment, such as, that which is addressed in the "Wheel Tractor/Loader Safety Manual" published by the Construction Industry Manufacturers Association, of Milwaukee, Wisconsin, and recognized by the International Union of Operating Engineers. No abatement certification or documentation is required for this item.
