Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) North End of Building, Store Front - Employee was observed standing on the platform of the JLG boom-supported elevating work platform (aerial lift) was not wearing a fall arrest system. This condition last existed on October 8, 1997. Among other methods, one feasible and useful method to correct this hazard is to develop, implement and enforce a work rule such as stipulated in American National Standards Institute A92.5 "Boom-Supported Elevating Work Platforms". No abatement certification or documentation is required for this item.
