Section 1926.5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of vehicular traffic striking them: a) Blue Mountain Drive and Elm Road - The flagman was standing at the end of a cone taper that was located at the bottom of a hill and around a corner on Blue Mountain Drive. The flagman was not visible to traffic until they drove around the corner, exposing the employee(s) to a hazard of vehicular accident, on or about 4/8/97. ABATEMENT NOTE: One feasible and acceptable means of abatement is to follow the proper traffic control standards such as: ANSI D6.1-1971 Manual On Uniform Traffic Control Devices For Streets And Highways or Work Zone Traffic Control Publication 203 (67 PA Code, Chapter 203) of the Pennsylvania Department of Transportation (April 1, 1994) as referenced in the Contract with the Lehigh Township Municipal Authority.
