Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Production department, north side of facility - On or about 07/09/98, employee(s) were observed standing and being raised on the forks of a TCM FCG15 fork lift truck to gain access to a product conveyor approximately 10 feet from the floor. This is prohibited by section 5.2.24 of the American Society of Mechanical Engineers (ASME) B56.1-1993. Among other methods, several feasible and acceptable abatement methods to correct this hazard includes: (1) use an approved platform that is securely attached to the lifting carriage or forks in accordance with ASME B56.1-1993 Section 5.2.24 which includes the platform having a means to protect employees from falls from elevations in accordance with Section 7.35, (2) use an alternate safe means to access the product conveyor such a ladder or scissors lift, and (3) provide training to employees on the safe means to access the product conveyor.
