Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an explosion and struck by hazard: (a)On or about 1/15/03 at the 200 Milens Road, Tonawanda, New York plant; employees clean 5 gallon premix tanks. The tanks are then pressurized with CO2 to assure the hoses are rinsed out. There is no pressure regulator device to assure that the tanks do not become overpressurized. The pressure relief valve blows at 130 psi and can cause employee injury. Feasible abatement methods include a) installing a regulator on the hose; b) using a portable regulator to indicate the tank fill, and c) training employees in the proper use of the regulator.
