Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a fall hazard from the personnel platform. Employees were exposed to a fall hazard from the personnel platform, in that, the work platform was not attached to the forks and the operator had left the controls unattended while employees were in an elevated position. Among other methods, one feasible and acceptable abatement method to correct this hazard is to instruct each employee that operates and work from the platform in the requirements of ASME/ANSI B56.6-1987, Safety Standard for Rough Terrain Forklift Trucks, Part II, 5-15 Elevating Personnel: 1. Ensure that the platform is securely attached to the lifting carriage or forks. 2. Ensure that the operator of the forklift is in a position to control the vehicle at all times while employees are in an elevated position.
