Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by unstable materials: a) Hotel Atrium, Lobby Balcony: Employees were utilizing a KD 1500 knock down lift in a manner that was not approved by the manufacturer. The equipment was being used with the boom in the opposite direction. On or about 06/22/98. One feasible and acceptable method among others to correct this hazard is to: 1. Re assemble the lift boom in accordance with the manufacturers directions. Assemble the upright column post into the cross axle with the flanges facing forward. 2. Use an appropriate outrigger type hoist.
