Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a falling tree limb:
On or about February 5, 1997, employee(s) working at 7926 W. 67th street,
Merriam, Kansas
were not adequately trained and instructed in the recognition and
avoidance of unsafe conditions
associated with tree work before the start of their employment and
whenever new unsafe
conditions existed.  Employee(s) were cutting branches of an oak tree
branch when it ripped
away from the tree and fell on an employee who was working underneath that
resulted in death.
Among other methods, one feasible and acceptable method to correct the
hazard is to follow the
recommendations outlined in the American National Standard for Tree
Operations Pruning,
Trimming, Repairing, Maintaining, and Removing Trees, Cutting Brush Safely
Requirements
(ANSI Z133.1 1994).  These recommendations address safe work procedures,
instructing  each
individual of his/her job assignments, clearing all workers not directly
involved in an operation
our of the area, safety requirements, and etc.
