Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to:
(a) On or about December 18, 1998 and at times prior thereto employees
were exposed to
the hazard of being struck by falling construction materials while working
on the remodeling
construction site at the M.S.U. College of Technology, Great Falls,
Montana due to
improper construction methods and the use of improperly selected material.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD IS:
1. Follow recognized construction methods for steel stud construction as
specified in
the plans, ASTM C1007, Uniform Building Code, and the Steeler, Inc. manual
which
includes, but is not limited to, the securing of both flanges  top and
bottom of the studs.
2. Provide materials to the jobsite as specified in the plans, and which
are suitable for
the intended use i.e. studs are not to be substituted for joist.
3. Ensure that all construction of load bearing walls is completed as
specified in the
plans and according to sound construction methods prior to imposing the
design loads.  This
includes properly sheathing the walls and the proper installation of any
bridging materials
specified in manufactures specifications.
