Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a.)Employees working in the marine terminal yard were exposed to being injured by the defective condition of the #38 Komatsu front endloader. The front endloader had various deficiencies such as but not limited to: Broken front and back windshield, bent access steps to the cab of the machine, missing back up alarm. One feasible means of correcting these hazards is to have the operators conduct daily inspections of the equipment and have maintenance performed on the noted items. ABATEMENT VERIFICATION REQUIREDTION
