Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing of likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift trucks in the event of a rollover: a) Loading Dock Area - Employees who operate forklift trucks were not required to wear protective restraint devices (seatbelts) that came equipped on the Hyster forklift trucks. Observed 06/04/98. ABATEMENT NOTE: AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO ENFORCE THEIR WORK RULE WHICH REQUIRES EMPLOYEES TO UTILIZE THE SEATBELTS. ABATEMENT NOTE: ABATEMENT CERTIFICATION REQUIRED
