Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to inhalation as well as fire/explosion
hazards as a result of off-gassing from a leaking liquid anhydrous
ammonia pipe in the refrigeration process:
a. M/V Woodbine, refrigeration deck - The employer failed to
develop and implement a routine/preventative maintenance and
testing program for such critical refrigeration system components
as the liquid feed line to the chillers.
b. M/V Woodbine, refrigeration deck - Where the leaking, liquid
feed line to the chillers demonstrated severe external corrosion,
the employer failed to replace this pipe, failed to apply
protective coatings, and failed to reapply insulation and an
appropriate vapor seal, as necessary, to prevent the release of
ammonia into the environment.
c. M/V Woodbine, refrigeration deck - Where anhydrous ammonia was
used as a refrigerant, the employer failed to either install a
fixed mechanical ventilation system that ran continuously or was
equipped with a vapor detection system that automatically started
the ventilation system and actuated an alarm at the lowest
practical detection limit not exceeding 4by volume.
ABATEMENT NOTE: Among others, one feasible and acceptable abatement
method after the leaking section of pipe has been replaced, would
be to develop or procure from the manufacturer, an instruction that
specifies a description of the process, operating instructions,
principles of operation, and maintenance/testing procedures. This
maintenance and testing program should include, for piping, such
elements as external inspection, thickness testing, nondestructive
testing, and/or the development of a changeout protocol based on
either objective findings or manufacturer's recommendations.
Finally, install a detection and ventilation system in accordance
with the requirements specified in ASHRAE 15 - 1992, Safety Code
for Mechanical Refrigeration.s.
