Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard of burns and smoke inhalation
due to fires involving flammable liquids and combustible gases:
Kenai Dock - Where the employer provided petroleum (fuel) services
to fishing vessels, the employer was required to maintain, in a
serviceable condition, adequate fire extinguishers suitable for
this hazard. Two of the three portable ABC/dry chemical fire
extinguishers at this location were partially discharged and as
such were not readily available for use in the event of a fire
during fueling operations. In addition, there was not an effective
fire extinguisher inspection program in place to assure
availability of operational fire extinguishing equipment.
ABATEMENT NOTE: Among other methods, one feasible and acceptable
abatement method to correct this hazard would be to maintain and
inspect fire extinguishers at least monthly and to document these
inspections; in addition, personnel responsible for conducting this
inspection should be trained regarding what the inspection must
entail.

this Occupational Safety and Health Standard or its equivalent
standard which was contained in OSHA Inspection Number 109430512,
Citation Number 1 Item Number 1, issued on 09/18/98.
