Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by and crushing hazards:
a)TVA Kingston Fly Ash Recovery Site - On or about 07/20/09, an employee
was exposed
to struck-by and crushing hazards when the load was not properly secured
to prevent
shifting.
Among other methods, one feasible and acceptable abatement to correct the
hazard is to: Secure
loads to prevent movement  in accordance with the Federal Motor Carrier
Safety Administration,
49 CFR Part 393.106(c)(1) Subpart I - Protection against shifting and
falling cargo which states
articles of cargo that are likely to roll must be restrained by chocks,
wedges, a cradle or other
equivalent means to prevent rolling.  The Web Sling & Tie Down
Association,
Inc., WSTDA-T-
1, Section 4.3.2 requires that synthetic web tie downs shall be attached
to the vehicle and
positioned to prevent against shifting and/or loss of cargo.
