29 CFR 1910.146(d)(3)(vi): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, verifying that conditions in the permit space are accepable for entry trhoughout the duration of an authorized entry: a) Tanker truck trailer - On or about February 19, 2014, an employee was working in a permit required confined space, inside a bulk tanker trailer which contained possibile atmospheric hazards and the atmosphere had not been tested prior to entry nor had any precautionary steps been taken to mitigate the potential atmospheric hazards.

29 CFR 1910.146(d)(4)(viii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that employees properly used rescue and emergency equipment needed to comply with 29 CFR 1910.146(d)(9): a) Tanker truck trailer - On or about February 19, 2014, an employee was working inside a bulk tanker trailer, a permit required confined space which required a ladder to climb down into the trailer for entry. A harness and non-entry retrieval device were not in use to facilitate rescue in an emergency situation. Exposing employee to entrapment and other confined space hazards in the event of an accident where self-rescue became impossible.
